By the order dated 15.11.2017 passed in C.W.J.C.No. 5177/2016 this Court directed the District Magistrate, Saran to examine the grievance of the petitioner as to non-issuance of appointment letter for the post of Vikash Mitra despite his selection and placement at serial no.1.
The claim has been disposed by an order bearing Memo No. 298 dated 24.2.2018 and Mr. Sinha, learned AC to GA-5 in reference to the operative portion of the order submits
Patna High Court MJC No.1462 of 2018(4) dt.15-05-2019 2/2 that the reason for non-appointment of the petitioner stands explained.
Although according to Mr. Tiwary, the order in rejecting the claim of the petitioner is in the teeth of the materials on record but then the claim of the petitioner having been considered on merits and rejected, the challenge thereto has to be made in an independent proceeding by filing a proper application.
While giving liberty to the petitioner to challenge the order of the Sub-divisional Officer, Marhaura, whereby the claim of the petitioner has been rejected enclosed at Annexure 'C' as referred to above, I dispose of the contempt application. (Jyoti Saran, J) Surendra/- U
