2. The petitioner seeks regular bail in connection with Parihar P.S. Case No. 353 of 2023 registered for the offence under Section 392 of the IPC.

3. As per allegation in the FIR, it is a case of robbery wherein three unknown miscreants took away the motorcycle of the informant alongwith bag containing Rs. 1,64,000/- and other articles.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the possession of the petitioner. He further submits that the petitioner is not named in the FIR. He next submits that investigation is already concluded and charge sheet has already been submitted in this

Patna High Court CR. MISC. No.39204 of 2024(3) dt.01-08-2024 2/2 case and no TIP has been held till date. Petitioner is in custody since 06.02.2024.

5. However, learned APP for the State vehemently opposed the prayer for regular bail.

6. Considering the facts and circumstances of the case and submissions made by the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sitamarhi / concerned Court in connection with Parihar P.S. Case No. 353 of 2023.
