JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-11-2015 This is an application for grant of regular bail in favour of the petitioners, who are accused in connection with Sono (Charkapathar) P.S.Case No. 93 of 2014 registered for the alleged offences punishable under Sections 364/34 of the Indian Penal Code.

As per prosecution case,the husband of the informant had gone with Raj Kumar Yadav on 25.2.2014. Thereafter, he did not return. The First Information Report came to be instituted on 03.06.2014 raising suspicion that because of land dispute between the husband of the informant and father-in-law, the First Information Report was instituted against two persons including the petitioner, might have been abducted and killed.

Patna High Court Cr.Misc. No.47489 of 2015 (2) dt.03-11-2015 2/2 Learned counsel for the petitioners appears to be right in his submission that the delay of more than three months in institution of the First Information Report casts doubt about the varacity of the accusation.

Considering the submission that the accusation against the petitioners is based on mere suspicion and the petitioners have no criminal antecedent, this application is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jamui in Sono (Charkapathar) P.S.Case No. 93 of 2014.

This is subject to the condition that the petitioners shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
