2. The petitioner superannuated long back in the year 2008. On account of inaction on the part of the respondent University authorities in not extending the retiral benefits and other dues, the petitioner had approached this Court by filing CWJC No. 1464 of 2013. Despite the order passed by the Writ Court, no payment was made; the petitioner filed MJC No. 4917 of 2014 which came to be disposed of vide order dated 20.07.2017. While disposing off the contempt petition, the Court had categorically observed that the authorities concerned shall also look into the grievance of the petitioner with respect
Patna High Court CWJC No.9678 of 2022 dt.10-07-2025 2/3 to payment of leave encashment along with other dues. In case the same does not find favour it shall be incumbent upon the Registrar to record reasons for the same and communicate it to the petitioner.

Notwithstanding the aforesaid fact, the claim of the petitioner with regard to leave encashment and provident fund in part with interest has not been settled till date, which compelled the petitioner to again approach this Court. The matter has been running on Board since 2022 but there is no response by the University authorities.

Considering the fact that the petitioner has already superannuated long back in the year 2008 and till date his remaining grievance, as has been noted hereinabove, has not been considered, this Court is left with no option but to direct the Registrar of the BRA Bihar University to take up the matter of the petitioner and consider her grievance with respect to leave encashment and provident fund in part with interest, preferably within a period of four weeks from the date of receipt/production of a copy of this order.
5. Suffice it to observe that in case the claim of the petitioner finds favour necessary monetary benefits shall be accorded to her within a further period of eight weeks.

6. In case of any defiance of the order, it shall be viewed seriously and the petitioner shall be entitled to realise penal interest over the delayed payment.
7. The writ petition stands disposed of.
