Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414, 120B of the Indian Penal Code.

The prosecution case is that 6-7 persons were found moving in a suspicious condition, when Amit Kumar Shukla and Dharmendra Kumar were apprehended. They disclosed the name of their associates whose name is mentioned in the F.I.R. and suggest that they used to keep the stolen motorcycles in the house of Ranjeet Rai and Anil Rai. From the house of the petitioner one pulsar motorcycle was recovered.

It is submitted by the learned counsel for the petitioner that recovery is from outside the house. Only on

Patna High Court Cr.Misc. No.3626 of 2016 (2) dt.22-01-2016 suspicion accusation has been levelled. For the same incident, two First Information Reports have been lodged being Lalganj P.S. Case no. 50 of 2015 and the present one as Lalganj P.S. Case No. 51 of 2015. Co-accused Amit Kumar Shukla has been granted regular bail vide Cr. Misc. No. 47208 of 2015 by a Coordinate Bench of this Court.

Let the learned court below consider the prayer for regular bail of the petitioner, keeping in view of the fact that the petitioner was not accused in any other case prior to the present one, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Lalganj P.S. Case No. 51 of 2015, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.

With the above observation this application is disposed of.
