JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 11.12.2014 in connection with Bochaha P.S. Case No. 325 of 2014 for the offences instituted under Sections 399, 402, 414 of the IPC, 25(1b)A, 26(ii), 35 of the Arms Act and 3⁄4 of the Explosive Substance Act.
The prosecution story, in brief, is that one automatic pistol alongwith three live cartridges, one mobile, four Tin boxes powder, thread, one lock and key kept in the bag were recovered from possession of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.12.2014 and the charge sheet has
Patna High Court Cr.Misc. No.34958 of 2015 (3) dt.05-10-2015 2/2 been submitted in the case. There is no allegation of tampering with the evidence. As per prosecution case, it is alleged that one pistol and three live cartridges alongwith substance like bomb explosive and other things are said to have been recovered from possession of the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur, in connection with Bochaha P.S.
