The petitioner seeks bail in Kuchaikote P.S. Case No. 120 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2018. It is alleged in the written report that informant received secret information that on some distance of village under Mahua tree four persons are standing having two bags in their hands. The Police went there. On seeing the Police party all the persons started running away after throwing their bags. Out of them one person was caught hold by the Police who disclosed his name as Vivek Singh (petitioner). Other accused persons managed to run away. On search of the bags, total 46.800 litres of illicit liquor has been recovered.

Patna High Court CR. MISC. No.36941 of 2019(2) dt.19-06-2019 2/2 Petitioner is in custody since 14.4.2019 having clean antecedent.

Keeping in view the clean antecedent of the petitioner, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District Judge-cum-Special Judge, Excise, Gopalganj, in connection with Kuchaikote P.S. Case No. 120 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
