1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 304/34 of the Indian Penal Code and Section 40 of the Clinical & Establishment Registration and Regulation Act, 2010.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and informant alleges that on 13.09.2023, while she along with the petitioner reached referral hospital, Ramgarh for the treatment and delivery of his wife namely Sanju Devi, when his wife was referred to District hospital, Bhabua but on advise of the petitioner she was admitted in C.T. Hospital, Ramgarh, where she was operated by the other accused persons, on account of

Patna High Court CR. MISC. No.39419 of 2024(2) dt.12-07-2024 2/2 which, she died. The learned counsel submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that the informant on his own volition has taken his wife to C.T. hospital, Ramgarh. It is also submitted that it is not the case of the informant that the petitioner performed the operation. It is next submitted that petitioner is in custody since 04.04.2024 and the charge sheet has been submitted.

4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ramgarh P.S. Case No.353/2023.
