JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 406, 409, 467, 468, 471, 504 and 506 of the Indian Penal Code. The prosecution case is that the informant being the Panchayat Mukhiya was requested by the villagers for getting them membership of PACCS for having the voting right when the informant requested to the petitioner being the PACCS chairman for making villagers membership of the PACCS, the petitioner took money from two hundreds persons but ultimately at the time of PACCS election, the villagers did not find their names in the voter list.

It is submitted by learned counsel for the petitioner that on investigation being concluded, the chargesheet has been

No.3509 of 2016 (2) dt.22-01-2016 2/2 submitted under Sections 504 of the IPC but differing with the final form, cognizance has been taken under Sections 406, 420, 409, 467, 468, 471, 504 and 506 of the IPC. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that during investigation, substantial accusation was not found true, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Saharsa in connection with Basnahi P.S. Case No. 86 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
