Heard the learned counsel for the petitioner. The present application under Article 227 of the Constitution of India has been filed by the petitioner, praying for quashing the impugned order by which the learned court below has confirmed the report submitted by the pleader commissioner after rejecting the prayer of the petitioner for review of the earlier order. After considering the submissions and the materials on record including the impugned order, it is manifest that the petitioner, in a final decree proceeding, filed a petition on 19.07.2012 for review of the order dated 18.05.2012 seeking permission to make correction in the compromise petition. The
Patna High Court CWJC No.9724 of 2014 dt.17-05-2016 learned court below has found that by earlier order dated 18.05.2012 the prayer on behalf of the plaintiff-petitioner for correction in the compromise petition was rejected on contest. Thereafter the present review application has been filed for review of the said order. The learned court below after considering the facts and circumstances of the case has passed the impugned order rejecting the prayer for review and passing the order confirming the report of the pleader commissioner. During the course of submission, this Court is not persuaded to find any illegality or material irregularity in passing the impugned order.
The application is, accordingly, dismissed.
