JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Complaint Case No. 660 of 2015 (Tr. No. 299/15), disclosing offence under Section 420 of the Indian Penal Code. The petitioner had earlier approached this Court for grant of anticipatory bail by filing an application which gave rise to Criminal Miscellaneous No. 49776 of 2015. The said application was dismissed by order dated 04.11.2015 as withdrawn. From the said order dated 04.11.2015 it appears that learned counsel for the petitioner sought permission to

Patna High Court Cr.Misc. No.5566 of 2016 (4) dt.11-07-2016 2/2 withdraw the said application, since the Court was not inclined to grant him privilege of anticipatory bail.

Learned counsel for the informant has rightly pointed out that this second application for the same relief should not be entertained.

Considering the above submission, this application stands rejected.

The petitioner, above-named, is directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
