The petitioner seeks bail in connection with Punaura P. S. Case No.51 of 2021, instituted for the offences under Sections 395, 397 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 24.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.
The learned counsel for the petitioner further submits that the informant alleges that in the night, 12-15 accused entered his house after breaking the lock and assaulted his son causing injury on his head and locked the entire family in a
Patna High Court CR. MISC. No.47504 of 2021(3) dt.21-03-2022 2/3 room and looted cash and ornaments.
The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case by showing some recovery of articles like one old Pila, one iron rod having pointed shape on both the sides, Aari meant for cutting of iron and small boxes for keeping ornaments. The learned counsel submits that none of the articles seized from his in-laws' place even remotely suggests that they were looted articles. The learned counsel further submits that the petitioner has not been put on T.I. Parade nor recovery of any looted articles have been made from his possession and the petitioner was arrested based on suspicion and was made to confess his crime in police custody.
Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Punaura P. S. Case No.51 of 2021, subject to condition that one of the bailors shall be the father of the
