2. The petitioner has preferred this application for grant of regular bail in connection with Darbhanga Sadar P.S. Case No. 330 of 2024 dated 12.09.2024 registered for the offences punishable u/s 126(2), 352, 324(2), 351(2), 115(2), 110 and read with section 3(5) of the BNS.
3. As per the prosecution case, the informant alleged that while he was standing at his door then the petitioner and the co-accused persons entered his house and on the exhortation of the co-accused Vishvanath Yadav, Suresh Yadav gave blow of iron rod on his head due to
Patna High Court CR. MISC. No.35662 of 2025(2) dt.16-06-2025 2/3 which he sustained head injury and fell on the ground and the other accused persons assaulted him with Lathi, Danda and fists and fled away. After which the informant's wife along with the neighbours took him to Darbhanga Medical College and Hospital, Darbhanga for treatment.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The specific allegation of assaulting with iron rod is against the co-accused Suresh Yadav. Similarly situated co-accused have already been granted bail by the co-ordinate bench of this court vide order dated 07.05.2025 passed in Cr. Misc. No. 25809 of 2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 27.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on
Patna High Court CR. MISC. No.35662 of 2025(2) dt.16-06-2025 3/3 bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Darbhanga in connection with Darbhanga Sadar P.S. Case No. 330 of 2024.
7. The application stands allowed.
