Informant who happens to be Deputy commandant, CRPF claimed that the petitioner and one other accused were arrested while they had gone to collect levy from the owner of brick-kiln and nexalite literatures were recovered from their conscious possession but submission on behalf of the petitioner is that the petitioner was picked up from his house by the officials of CRPF without giving any information to the concerned police station and when officer-in-charge of Bandeya police station learnt about the above stated incident, he immediately gave information to Superintendent of Police, Aurangabad on 8.7.2015 which is evident from perusal of annexure 2 to this petition.

Considering the aforesaid submissions as well as this aspect of the matter that the petitioner does not have any criminal antecedent,

Patna High Court Cr.Misc. No.46563 of 2015 (2) dt.05-10-2015 let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Tekari P.S. Case no. 261/2015.
