The petitioner apprehends arrest in connection with Garkha P.S. Case No. 156 of 2015 for offence punishable under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR and there has been no recovery rather his name has transpired in the Statement made by the coaccused. No case for anticipatory bail is made out. Application is disposed of.

The petitioner should surrender before the court below and pray for regular bail which should be considered on its own merit and be disposed of without being prejudiced by the order passed in this application.
