JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Rajgir P.S. Case No. 679 of 2022, registered for the offence punishable under Sections 363, 366-A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent. There is no specific, general and omnibus allegation against the petitioner. Petitioner is in custody since 15.02.2023.

Learned APP has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.38552 of 2023(2) dt.05-07-2023 2/2 Considering the statement of the victim girl under section 164 Cr.P.C. and the period of custody, this application is allowed.

Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the court of learned C.J.M., Biharsharif, Nalanda in connection with Rajgir P.S. Case No. 679 of 2022.
