2. The present petition has been preferred for the following relief(s):

"(i) for issuance of a writ in the nature of a writ of mandamus or any other appropriate writ / order / direction directing the State officials not to construct a Panchayat Bhawan over the raiyati land of the Petitioner, which was acquired by him through a valid sale deed, dated 14.06.2016, executed by the legal heirs of the lady whose name finds mention in the possession

Patna High Court CWJC No.9630 of 2025(2) dt.23-06-2025 2/2 column of the Revisional Survey Khatiyan.

(ii) the Petitioner further prays for issuance of any other appropriate writ / direction/ order in the facts of the case."

3. Learned counsel for the petitioner submits that despite the land belonging to him, the Panchayat Bhawan is being constructed.

4. Learned counsel for the State submits that it is a 'Gair Majarua Aam' land on which the construction is being made.

5. Such a disputed question of fact/law cannot be decided in a writ Court. The petitioner has already approached the respondents and if so wants can approach the Collector, Darbhanga in next four weeks along with a proper representation who shall be deciding the matter at an earliest.

6. Needless to say that the ultimate domain for the petitioner lies before the competent Civil Court.

7. The writ petition stands disposed of.
