JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for grant of regular bail on behalf of the petitioner who is an accused in Mahila PS Case (Bhabhua) No. 17 of 2015 for the alleged offence under Section 376 of the Indian Penal Code, which is pending in the court of learned Sub Divisional Judicial Magistrate, Bhabhua. It is submitted on behalf of the petitioner that for an occurrence alleged to have taken place on 20.3.2015, the first information report was instituted on 31.3.2015. He contends that the informant has given different dates of occurrence at different stages which creates serious doubt over the veracity of the allegation as contained in the FIR.

It appears that the petitioner is in custody since

Patna High Court Cr.Misc. No.29531 of 2015 (3) dt.05-10-2015 2/2 1.4.2015 and, therefore, charge-sheet must have been submitted by now.

In view of the above, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs.10,000/ (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhabhua, in connection with Mahila PS (Bhabhua) Case No. 17 of 2015.
