This is an application for grant of regular bail on behalf of the petitioner who is an accused in Gopalpur PS Case No. 116 of 2015 for the alleged offence under Sections 376, 511 and 323 of the Indian Penal Code, pending before the court of learned Chief Judicial Magistrate, Bettiah, District West Champaran.
It is alleged against the petitioner that he entered into the house of the informant and attempted to commit rape on her. Learned counsel for the petitioner submits that the manner of occurrence as alleged in the first information report is highly improbable.
Patna High Court Cr.Misc. No.45000 of 2015 (3) dt.05-10-2015 2/2 Keeping in view the nature of allegation and the fact that the petitioner is in custody since 16.8.2015, this application is allowed. Let the petitioner above-named be released on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, District West Champaran, in connection with Gopalpur PS Case No. 116 of 2015. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
