JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-03-2021 As prayed for, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 14.12.2020, within four weeks of starting of the Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sherghati (Dobhi) P.S. Case No.55 of 2019 registered under Sections 147, 148, 149, 341, 323, 337, 338, 332, 333, 307, 353, 120B and 504 of the Indian Penal Code besides Section 27 of the Arms Act.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that on the basis of the written

No.34799 of 2020(2) dt.26-03-2021 2/2 report of the informant Sheelanath Singh, A.S.I. of Dobhi Police Station, the present case was instituted against 18 named accused and some unknown. In course of investigation, the name of the petitioner surfaced in the supervision note of the A.S.P. without any specific overt act. In fact, the petitioner is accused in two other cases, as detailed in paragraph-3 to this application, in which he is on bail, due to that reason, the police with an ulterior motive has falsely implicated the petitioner in the present case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sherghati, District-Gaya, in connection with Sherghati (Dobhi) P.S. Case No.55 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
