JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 354 and 307/34 of the Indian Penal Code.

The accusation is that on 14.07.2015, the accused persons began abusing and assaulted the informant by fists and slaps. It is further alleged that the petitioner assaulted by means of spade on the temple of Guriya Kumari causing cut injury. It is submitted by learned counsel for the petitioner that the petitioner is the agnate of the informant and in the background of land dispute, the accusation has been levelled. The injury report of Guriya Kumari suggests one abrasion and pain in the whole body. The injury has been found to be caused by hard and blunt substance.

No.3530 of 2016 (2) dt.22-01-2016 2/2 Considering the accusation not being corroborated with the medical opinion, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Nawada in connection with Akbarpur P.S. Case No. 182 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
