JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is said to have opened fire by country made rifle causing fire arm injury to informant's son. So far as the other accused are concerned, according to the prosecution case, almost all the accused assaulted the injured. Furthermore, according to the prosecution case, the alleged occurrence took place on account of land dispute. The injury report of victim Shailesh Yadav reveals that two injuries, said to be caused by fire arm, were found on the person of the injured and out of the aforesaid two injuries, one injury was found simple in nature and opinion regarding the other injury was kept reserved but till the passing of the impugned order dated 8.4.2015, the

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking into note of this fact that the petitioner is in jail custody since 24.3.2015 and the investigation against the petitioner has already been completed, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khagaria (Muffasil) P.S. Case No.632/2013 to the satisfaction of the Chief Judicial Magistrate, Khagaria.
