The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code.

Diary in this case was called for earlier which has since been received.

After hearing learned counsel for the petitioner and on perusal of the case dairy, it appears that the allegations are wholly frivolous and concocted and have no basis whatsoever. It is submitted that there is no cogent material in the case diary to support the prosecution case.

Considering the facts and circumstances and that the

No.4381 of 2016 (3) dt.26-04-2016 petitioner has no criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West Muzaffarpur, in connection with Deoria P.S. Case No. 72/2013, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
