The petitioner has filed the instant application apprehending his arrest in connection with Maranchi P.S. Case No. 130 of 2018 registered for the offences under Sections 467,468,471 and 420 of the Indian Penal Code. As per the prosecution case the allegation against the petitioner is that the mark sheet of BA Part - I submitted by the petitioner along with his application for PDS dealership was forged.
It is submitted by learned counsel for the petitioner that the petitioner had no reason to submit the forged mark sheet as alleged by the prosecution for the reason that he was only candidate having passed B.A Part I examination amongst the
Patna High Court CR. MISC. No.34422 of 2019(2) dt.27-05-2019 2/2 applicants for PDS dealership of Maranchi village. Learned APP appearing for the State opposes the prayer for bail.
Having heard the learned counsel for the petitioner and the learned APP for the State, in view of the facts and circumstances stated herein above, I am inclined to enlarge the petitioner on bail. Let the petitioner namely, Vickey Kumar surrender in the Court below within four weeks from today. In case of his arrest or surrender, he be enlarged on bail on furnishing bail bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh in connection Maranchi P.S. Case No. 130 of 2018 subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code. (Partha Sarthy, J) Prakash/- U
