JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 493,313 and 376 of the Indian Penal Code.

The prosecution case is that co accused Ranjeet Kumar on the promise to marry, established physical relationship and subsequently the pregnancy was terminated at the behest of the petitioner and the mother of Ranjeet Kumar.

It is submitted by the learned counsel for the petitioner that the thrust of accusation is against co accused Ranjeet Kumar. There is nothing on record to show termination of pregnancy and even accepting the accusation the case under section 376 IPC is made out against co accused Ranjeet Kumar.
