JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-07-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Pupri P.S. Case No. 417 of 2021, registered for offence punishable under sections 302, 120(B)/34 of the Indian Penal Code.

As per allegation, one Ram Bahadur Mukhiya mentioned the informant that her daughter was seen talking with co-accused Sharman Mahto. Thereafter, her daughter came back to her home and after taking meal she slept in the night. At about 11:00 P.M. when the informant woke up, she could not find her daughter on her bed and on search, no trace was found of her daughter. The informant suspected that the petitioner and

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has submitted further that the case of the petitioner is on better footing than co-accused Sharman Mahto, who has been granted bail by a coordinate Bench of this Court by a coordinate Bench of this Court in Cr. Misc. No. 22013 of 2022. The petitioner is under custody since 11.12.2022. He has also submitted that the petitioner was granted anticipatory bail, vide order dated 10.01.2023, but before his release he was arrested. On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Pupri P.S. Case No. 417 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when
