JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-07-2019 While hearing this matter, it was pointed out by Ms. Smriti, learned advocate appearing for opposite party no. 2 that prior to the order passed by this Court on 29.10.2018 staying all further proceedings in the court below, the petition for discharge preferred by the petitioners no. 1 and 2 had already been rejected by the court below.

In the present petition, the order of cognizance has been challenged.

No.23141 of 2017(3) dt.16-07-2019 2/2 Mr. Krishna Prasad Singh, learned senior advocate assisted by Mr. Samir Kumar, learned advocate submits that this fact was not brought to their notice and therefore it could not be placed before this Court. Mr. Singh, learned senior advocate seeks permission to withdraw this petition in order to enable the petitioner to challenge the order passed by the court below refusing to discharge petitioners no. 1 and 2. The petition is permitted to be withdrawn with the liberty aforesaid.
