The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code.
It is a case of dowry death of the deceased due to non-fulfilment of dowry demand of a motorcycle and other articles.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is the mother-in-law of the deceased, namely, Kajal Devi and Kajal Devi is the wife of coaccused Luvkush Mahto (husband) and entire responsibility is fixed upon the husband of the deceased who is in judicial
Patna High Court CR. MISC. No.46073 of 2021(2) dt.12-04-2022 2/2 custody and petitioner has no concern with the mess and business of the deceased and her husband. Petitioner has got clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioner, above named in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Basantpur (Lakdinabiganj O.P.) P.S. Case No. 74 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
