JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 324, 34 of the Indian Penal Code.

The prosecution case is that the petitioners and others assaulted the informant and her daughter. It appears that the case was registered in the year 2001. The impugned order suggests that the processes under Sections 82 and 83 Cr.P.C have already been issued. It is submitted by learned counsel for the petitioners that petitioners were on police bail. Considering the fact that case was instituted in 2001 and processes under Sections 82 and 83 Cr.P.C proceedings have already been issued, this Court is not inclined to consider the prayer for anticipatory bail.

No.4450 of 2016 (2) dt.01-02-2016 2/2 Let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Paraiya P.S. Case No. 87 of 2001, Trial No. 03 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Gaya. With the observations above, the application stands disposed of.
