This application for anticipatory bail arises out of Bakhtiyarpur P.S. Case No. 437 of 2018, disclosing offences under Sections 420, 406 and 409 of the Indian Penal Code. Allegedly, because of wrong entries made in the measurement book, excess payment has been made and public money has, thus, been misappropriated. The petitioner, at the relevant point of time, was working as an Assistant Engineer. Learned counsel for the petitioner has submitted that the entries are made by the Junior Engineer, who is also an accused and has been granted anticipatory bail by this Court by order dated 02.05.2019, passed in Cr. Misc. No. 28499 of 2019. Considering the above submission, this application is

Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 437 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
