This is a petition for grant of regular bail for offence under Sections 366 and 367 of the Penal Code. It is alleged that one Raj Sah and Monu Sah were instrumental in kidnapping as they were intending to marry the girl, hut, having regard to the fact that the parents of the victim was not ready to marry so they used force. However, the petitioner is the driver of the said vehicle in which the victim was kidnapped.
The learned counsel for the petitioner submits that the petitioner has no concern. However, he was the person who was driving the car in which the kidnapping alleged to have taken place and the main allegation is against Raj Sah and Monu Sah. The petitioner has remained in jail about six months. Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Darbhanga Town P.S. Case No. 145 of 2015 to the satisfaction of the Chief Judicial Magistrate, Darbhanga. (Gopal Prasad, J) SA/- U √ T √
