This application for grant of regular bail arises out of Ahiyapur P.S. Case No. 114 of 2015, disclosing offence under Section 392 of the Indian Penal Code.
It is submitted on behalf of the petitioner that he was not named in the First Information Report and his name surfaced on the basis of confessional statement of co-accused Raju Tiwary. He further submits that there is no material against the petitioner to connect with the offence, alleged, over and above, the said confessional statement of the co-accused. Bringing to my notice, the order of this Court dated 31.07.2015 passed in Criminal Miscellaneous No.27538 of 2015, whereby the said Raju Tiwary
Patna High Court Cr.Misc. No.47419 of 2015 (2) dt.29-10-2015 2/2 has been granted regular bail, learned counsel for the petitioner submits that the present petitioner be also granted bail. In view of the submission as above, this application is allowed.
Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 114 of 2015.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
