JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-07-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 354B, 379, 380, 427, 447, 504, 506/34 of the Indian Penal Code.
As per prosecution case, all the FIR named accused persons including the petitioner came at the house of informant and started assaulting his family members. During course of this incident, the petitioner assaulted the informant's brother Rambabu Yadav by means of sword due to which he sustained injury. Further, other accused persons also took away golden chain as well as other articles from the house of the informant. Learned counsel for the petitioner submits that the

Both the parties are agnates and this petitioner has falsely been implicated in this case due land dispute. The injury report of the injured Rambabu Kumar which is annexed as Annexure-2, shows that the nature of injury is simple. It is further submitted that the petitioner is languishing in judicial custody since 18.4.2023.
Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kalyanpur P.S. Case No. 117 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd A.C.J.M, Motihari, East Champaran.
