2. The petitioner seeks regular bail in connection with Chakmehsi P.S. Case No. 191 of 2022 registered for the offence under Sections 341, 323, 324, 307, 447, 504/34 of the Indian Penal Code and further added Section 302 of the IPC.
3. The petitioner is accused of assaulting the victim. The victim died after about 10 days of occurrence.
4. Learned counsel for the petitioner submits that no offence under Section 302 of the IPC is made out against the petitioner in view of the aforesaid circumstances. The petitioner is in custody since 20.03.2025. He further submits that one of the co-accused namely Lala Sahni has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 32554 of 2023
Patna High Court CR. MISC. No.36427 of 2025(2) dt.18-06-2025 2/2 dated 01.11.2023.
5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case as well as the submission of the learned counsel for the petitioner, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Addl. District and Sessions Judge, Samastipur/concerned Court below in connection with Chakmehsi P.S. Case No. 191 of 2022.
