JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2020 Heard Mr. Manoj Kumar, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Ara Muffasil P. S. Case No. 136 of 2020 dated 05.05.2020, instituted for offences under Sections 147, 148, 149, 341, 323, 307, 302, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

Though the petitioner has been named in the F.I.R. along with 25 named accused persons and 10-15 unknown persons, but no specific act of assault has been attributed to him.

It has been submitted on behalf of the

Patna High Court CR. MISC. No.33552 of 2020(2) dt.16-12-2020 2/2 petitioner that taking the allegation on its face value, the petitioner can only be said to be the member of the mob.

Apart from this, it has been submitted that the petitioner is in custody since 28.05.2020 and that he has no criminal antecedents.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - 7 or concerned court, Bhojpur at Ara, in connection with Ara Muffasil P. S. Case No. 136 of 2020.

The petition stands allowed.
