The petitioner seeks regular bail in connection with Sidhwalia P.S. Case No. 238 of 2019 registered under sections 363, 366(A), 302 and 201/34 of the Indian Penal Code. The informant is the father of the victim, who allegedly went missing on 15.12.2019. The First Information Report was registered on 19.12.2019 with the allegation that coaccused Vikki Kumar in regular touch with the victim through mobile phone. He also mentioned in the First Information Report that there was dispute going on between the informant and co accused Tasulim Mian and this petitioner. The informant accordingly raised suspicion in the First Information Report that the petitioner and others, named therein, might have kidnapped the victim.

Learned counsel appearing on behalf of the petitioner has submitted that except for suspicion, there is absolutely no material against this petitioner to connect him with the offence as alleged. He has further submitted that co-accused Tasulim Mian, situated similarly, has been allowed regular bail by this Court by an order dated 14.10.2020 passed in Cr. Misc. No. 20505 of 2020.

Considering the circumstance as aforesaid, this application is allowed.

Accordingly, the petitioner, above named, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. 14th, Gopalganj, in connection with Sidhwalia P.S. Case No. 238 of 2019.
