JUSTICE SUDHIR SINGH ORAL ORDER 06-10-2015 Since both applications arise out of Bhagwanpur P. S. case no. 57 of 2015, they have been heard together and are being disposed of by this common order.
The petitioners seek bail in a case instituted under Section 304B/34 of the Indian Penal Code.
Allegation against the petitioners of both petitions is of torturing and killing daughter of the informant due to nonfulfilment of demand of dowry.
Patna High Court Cr.Misc. No.33299 of 2015 (3) dt.06-10-2015 2 / 2 It has been submitted on behalf of the petitioners that they have no criminal antecedent. Petitioners of Cr. Misc. no. 33299 of 2015 and Cr. Misc. no. 39966 of 2015 are in custody since 2.5.2015 and 19.7.2015 respectively. There is no allegation of tampering with the evidence against the petitioners. Petitioner Sheo Shankar Singh is father-in-law of the deceased and petitioner Gujrawati Devi is mother-in-law of the deceased. There is no direct or indirect evidence against the petitioner. The main allegation is against the husband of the deceased. Petitioners are separate from mess and property of the husband of the deceased. On behalf of the State and the informant, it is submitted that the petitioners are named in the F.I.R. and had participated in the alleged crime.
Considering the aforesaid facts and circumstances, let the above named petitioners of both petitions be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua , in connection with Bhagwanpur P.S.
