The petitioners seek bail in connection with Tikapatti P.S. Case No.41 of 2015 registered under Sections 147, 148, 149, 323, 325, 307, 302 and 120-B of the Indian Penal Code. The accusation is of killing Chamaklal Mandal, the father of the informant, Kundan Mandal by all the eight F.I.R. named accused including the petitioners due to land dispute through lathi causing injury to him, who, later on, died. Learned counsel appearing on behalf of the petitioners submits that there is general and omnibus allegation against all the eight F.I.R. named accused including the petitioners to cause
Patna High Court Cr.Misc. No.48086 of 2015 (2) dt.30-10-2015 2/2 injury to the deceased, the father of the informant, and in the postmortem examination of the deceased, only one injury was found on his person. Moreover, other six F.I.R. named accused have already been granted either anticipatory bail or regular bail by this Court.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Purnea, in connection with Tikapatti P.S. Case No.41 of 2015.
