JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 364/365 of the Indian Penal Code.
Informant has suspected that the petitioner and other accused persons killed his daughter and disposed of the dead body secretly.
Learned counsel for the petitioner submits that in fact after settlement of the dowry case, informant's daughter was residing with the petitioner and later on both went to Mumbai. After sometime, she fled away which had been informed to Mumbai police but no case was registered. Thereafter, petitioner came to the native house and narrated the incident. It is further submitted that FIR was lodged after delay of three
Patna High Court CR. MISC. No.46992 of 2021(3) dt.12-07-2022 2/2 years and there is no plausible explanation of delay. It is also submitted that the petitioner and his wife were daily wager in Mumbai and his wife might have fled away somewhere as no dead body has since been recovered.
Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner that he along with others killed his wife in a planned conspiracy.
Considering the rival submissions of the parties and the fact that the petitioner is the husband of the victim who is trace-less in suspicious condition while living with him in Mumbai, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
