The petitioner seeks bail in connection with Govindganj (Malahi) P.S. Case No. 140 of 2023 registered for the offence under Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 11.03.2023 and he is quite innocent and no recovery has been made from the possession of the petitioner.

The allegation against the petitioner is that there is recovery of 397.4 liters of foreign liquor from the vehicle in question whose driver was the petitioner.

Patna High Court CR. MISC. No.38799 of 2023(2) dt.05-07-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the allegations levelled against the petitioner, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.1, East Champaran, Motihari in connection with Govindganj (Malahi) P.S. Case No. 140/2023.

The petitioner will mark his attendance at the Kotwa Police Station, East Champaran on the every Sunday of each month.

Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Shishir/- U T
