JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-07-2019 Heard learned counsel for the petitioner and the State. The issue involved in the present writ application is covered by the judgment of the Apex Court in the case of Mukesh & Ano. Vs. The State of Bihar & Ors., reported in (2017) 5 SCC 383.

In view of the judgment of the Apex Court in the case of Mukesh & Ano. (supra), no positive direction can be issued

Patna High Court CWJC No.13390 of 2019(2) dt.04-07-2019 2/2 to the respondents to consider the case of the petitioner for appointment on regular post of Class-III or Class-IV posts except in accordance with the guideline indicated in the aforesaid judgment of the Apex Court.

Accordingly, the writ application is disposed of with a direction to the respondents to take final decision with regard to the claim of the petitioner in the light of judgment of the Apex Court in the case of Mukesh & Ano. (supra) at the earliest preferably within a period of 60 days from the date of receipt/production of a copy of this order.
