The petitioner apprehends her arrest in Supaul P.S. Case No. 28/2015, registered for the offences punishable under Section 306, 34 of the Indian Penal Code.
The mother of the victim made allegation that her daughter was married with the Bishnudeo Mukhiya about ten years ago and husband and in-laws of the daughter gave poison to her which caused the death of her daughter.
It is submitted that the petitioner is the mother-in-law of the deceased. No specific allegation is made against the petitioner. The deceased was married ten years ago, but during that period the victim did not make any sorts of allegation against any family members either for demand of dowry or torture.
Patna High Court Cr.Misc. No.40845 of 2015 (2) dt.06-10-2015 2/2 Considering the facts aforesaid, the petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No.28/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
