JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-01-2021 Heard Mr. Gopal Kumar Jha, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Special Case No. 634 of 2020 arising out of Palasi P.S. Case No. 266 of 2020, dated 18.08.2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It appears from the prosecution report that 48.00

Patna High Court CR. MISC. No.35071 of 2020(2) dt.06-01-2021 2/2 litres of cough syrup was recovered from the house of the petitioner.

It has been submitted on behalf of the petitioner that he is in custody since 19.08.2020 and has clean antecedents.

Regard being had to the afore-stated two facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions JudgeCum-Special Judge, Araria in connection with Special Case No. 634 of 2020 arising out of Palasi P.S. Case No. 266 of 2020.
