JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the father of the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
The basic accusation is of torture.
It appears that the complaint was filed in the year 2004 and the earlier anticipatory bail application was rejected by learned Sessions Judge on 24.09.2014 when the present anticipatory bail application has been filed in the year 2016. In the circumstance, this Court is not inclined to interfere. However, considering the nature of accusation and the fact that the petitioner is old person, it is a case for consideration
Patna High Court Cr.Misc. No.5032 of 2016 (2) dt.30-01-2016 2/2 of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Complaint Case No. 224C of 2004 pending in the court of learned JM, 1st Class, Jamui. Accordingly, the application is disposed of.
