The petitioner apprehends his arrest in connection with Nasriganj P.S. Case No. 74 of 2014 registered for the offences punishable under Sections 364, 120(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that although the allegation is based on speculation, it is true that the informant's husband had gone to hospital with this petitioner for operation of his eye and thereafter, he disappeared from the hospital. However, there is no substantial evidence against the petitioner so as to implicate him in the offence, as alleged. Considering the aforesaid submissions and also the fact that the petitioner has no criminal antecedent, let the petitioner
Patna High Court Cr.Misc. No.5162 of 2016 (2) dt.23-02-2016 above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bikramganj, Rohtas in connection with Nasriganj P.S. Case No. 74 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
