JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 447,341,323,307 and 504/34 of the Indian Penal Code and section 27 of the Arms Act. It is alleged that the petitioner along with Shyamdeo Yadav and Akhilesh yadav came variously armed when co accused Akhilesh Yadav assaulted the informant with iron rod on the head of informant. When Raju Yadav came to rescue, he was assaulted by co accused Shamdeo Yadav , thereafter other accused persons made assault. The petitioner Motilal Yadav and Akhilesh Yadav resorted to fire causing injury on the brother of the informant.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.3700 of 2016 (2) dt.25-01-2016 2/2 that the injury is simple in nature and the accusation has been levelled in the background of land dispute.
Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Manjhagarh P.S. Case No.140 of 2015 pending in the court of learned J.M. Ist Class, Gopalganj.
This application is disposed of with the aforesaid observation/direction.
