JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Piprakothi P.S. Case No. 295 of 2022, registered for the offence punishable under Sections 188/272/273/414/420/34 of the Indian Penal Code and sections 30(a)/41/(i) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from the conscious possession of the petitioner. There is no compliance of Section 100(2) of the Cr.P.C. Petitioner is in custody since 12.04.2023.

Learned APP has vehemently opposed the prayer for

Patna High Court CR. MISC. No.38565 of 2023(2) dt.05-07-2023 2/2 bail.

Considering the amount of recovery, this application is allowed.

Let the petitioner, above named, be released on bail, after completion of six months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court no. 1, Civil Court, East Champaran at Motihari, in connection with Piprakothi P.S. Case No. 295 of 2022.

This is also subject to the conditions that (I) the petitioner shall mark his presence in Piprakothi Police Station, District- East Champaran at Motihari on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
