ANJANA MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 364/366/(A) of the Indian Penal Code.
Learned counsel for the petitioners submits that save and except suspicion, there is no further material so as to implicate these petitioners. It is submitted further submitted that petitioners come from a respectable family and on account of matrimonial dispute, the name of present petitioners have been brought in. However, it appears that the victim girl has given a statement under Section 164 of the Cr. P.C. in which she has clearly stated that the petitioner had taken her away and he indulged immoral acts after keeping her forcibly confined her in a
Patna High Court Cr.Misc. No.4349 of 2016 (2) dt.26-04-2016 place.
Considering the statement made under Section 164 of the Cr. P.C. and the clear allegation made against the petitioner, I am not inclined to grant anticipatory bail to these petitioners in connection with Araria P.S. Case No. 161 of 2015, It is accordingly rejected.
