The petitioner seeks bail in connection with Sitamhari P. S. Case No.438 of 2021, instituted for the offences under Section 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 25.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 1777.500 litre of liquor from the house of Nagendra Singh.

The learned counsel for the petitioner submits that the wife of Nagendra Singh was arrested, who disclosed the name

Patna High Court CR. MISC. No.45975 of 2021(2) dt.10-12-2021 2/2 of this petitioner. As such, the name of this petitioner has come on the confessional statement of co-accused and based on that, the petitioner has been falsely implicated in the case. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 25.06.2021, he is a person with clean antecedent, chargesheet has been submitted in this case and his name came on the confessional statement, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cumSpecial Judge, Excise Act, Sitamarhi in connection with Sitamarhi P. S. Case No.438 of 2021.

The application stands allowed.
