The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 341/342/448/504/323/328/354-B/34 of the Indian Penal Code and Section 3⁄4 of the Witchcraft Practices Prohibition Act, 1999. Learned counsel for the petitioners submits that the entire case is false and mischievous and the parties being neighbours have been on litigating terms. It is further submitted that the wife of petitioner No. 2 (Shankar Rai) has also filed a case bearing
Patna High Court Cr.Misc. No.3824 of 2016 (2) dt.12-04-2016 P2/2 Mahila P.S. Case No. 61 of 2015.
Considering the nature of allegations made and that the parties have been litigating terms for various reasons, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Mahila P.S. Case No. 63 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
